Terms of Service

These Terms of Service ("Terms") constitute a legally binding agreement between you ("User", "you") and Hoorly ("we", "us", "the Service"). By creating an account or using Hoorly, you agree to these Terms, our Privacy Policy and our Community Guidelines.

1. Eligibility

You must be at least 18 years of age to use Hoorly. By registering, you represent and warrant that:

You may not impersonate another person, create multiple accounts, or transfer your account to anyone else. You must promptly notify us at support@hoorly.com if you suspect unauthorized access to your account.

You agree not to use Hoorly to:

Violation of this section may result in immediate account suspension or permanent termination, at our sole discretion. Serious violations (e.g., CSAM, threats of violence) will be reported to the appropriate law-enforcement authorities.

4. User Content

You retain ownership of the content you upload to Hoorly (photos, posts, messages, stories). By uploading content, you grant Hoorly a worldwide, non-exclusive, royalty-free, transferable, sub-licensable license to host, store, display, reproduce, moderate, cache and distribute that content solely as necessary to operate and improve the Service.

This license terminates when you delete your content or your account, except where the content has been shared with other users (e.g., messages sent) or where retention is required for legal or safety purposes.

You represent that you have the right to upload any content you share and that it does not infringe the rights of any third party.

5. Content Moderation and Safety

Our safety measures, reporting channels, moderation standards and DSA point of contact are described in detail in our Safety Center, which forms part of these Terms.

Hoorly employs a combination of automated systems and human review to detect and remove content that violates these Terms or our Community Guidelines. We may, at our sole discretion:

We strive to apply enforcement consistently and proportionally. However, we are not obligated to monitor all content and do not guarantee that all violations will be detected or addressed.

6. Premium Features and Payments

Hoorly offers optional paid features ("Hoorly+"). Purchases are processed through the Google Play Store or Apple App Store. By purchasing a subscription or consumable product, you agree to the applicable store's terms of sale.

Statutory right of withdrawal (EU/EEA consumers). Purchases are concluded with Apple or Google as the merchant of record; any statutory 14-day right of withdrawal under Directive 2011/83/EU (§§ 355, 356(5) BGB) is exercised through the respective store. For digital content, the stores request your express consent to immediate performance and your acknowledgement that the right of withdrawal is thereby lost; the stores' own refund procedures remain available.

Premium features are provided on a per-account, non-transferable basis. We reserve the right to modify, replace or discontinue premium features with reasonable notice.

7. Boost and Consumable Products

Boost and other consumable in-app purchases take effect immediately upon purchase and cannot be refunded once activated, except as required by applicable law or the relevant app store's refund policy.

8. Intellectual Property

The Hoorly name, logo, design, code, features and documentation are owned by Hoorly or its licensors and are protected by intellectual-property laws. You may not copy, modify, distribute, reverse-engineer or create derivative works from any part of the Service without our prior written consent.

9. Account Deletion

You may delete your account at any time via Settings → Account → Delete Account. Deletion is permanent and irreversible. Upon deletion:

You use Hoorly at your own risk. We strongly recommend exercising caution when meeting people in person and never sharing financial information with other users.

11. Limitation of Liability

We are liable without limitation (i) for damage caused intentionally or by gross negligence, (ii) for injury to life, body or health, (iii) under the German Product Liability Act (Produkthaftungsgesetz), and (iv) where we have assumed an express guarantee.

For damage caused by simple negligence, we are liable only where an obligation is breached whose fulfilment is essential to the proper performance of the contract and on whose observance you may regularly rely (Kardinalpflicht); in that case our liability is limited to the foreseeable damage typical for this type of contract.

Any further liability is excluded. To the extent our liability is excluded or limited, this also applies in favour of our employees and agents. Liability for loss of data is limited to the recovery effort that would have been necessary had the user made regular, risk-appropriate backups.

12. Indemnification

You agree to indemnify, defend and hold harmless Hoorly and its affiliates from and against any claims, damages, losses, liabilities, costs and expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

13. Governing Law and Dispute Resolution

These Terms are governed by the laws of the Federal Republic of Germany, without regard to conflict-of-law provisions. If you are a consumer resident in the EU/EEA, you also retain the protection of mandatory provisions of the law of your country of residence.

Any dispute arising from these Terms shall be submitted to the competent courts in Germany. For consumers in the EU, the European Commission's Online Dispute Resolution platform is available at ec.europa.eu/odr. We are not obligated to participate in alternative dispute resolution proceedings before a consumer arbitration body, but may choose to do so.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.

15. Changes to These Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via in-app notice or e-mail at least 14 days before they take effect. Your continued use of Hoorly after the effective date constitutes acceptance of the revised Terms. If you do not agree with the changes, you may delete your account before the effective date.
